Certificates of Authorization

Overview

A Certificate of Authorization (CofA) issued under the seal of the APEGM, certifies that a partnership, corporation, or other legal entity, is entitled to practice Professional Engineering or Geoscience within the province of Manitoba, through partners or employees who are Registered Members or Temporary Licensees of APEGM. APEGM classifies companies into three categories:

Sole Practitioner: A P.Eng. or P.Geo. who owns their own company, employs no other Professional Members, has five or fewer employees, and takes responsibility for all the work done. This requires a Certificate of Authorization.

Operating Entities: Where all Professional Services are consumed internally in the creation of a product that the operating entity sells, and no Professional Services are offered outside of that scope. These companies do not require a Certificate of Authorization.

Practicing Entities: A corporation that offers Professional Services, directly or indirectly, by more than one P.Eng. or P.Geo. who take responsibility for the work. This requires a Certificate of Authorization.

Companies that fall into the Sole Practitioner or Practicing Entity categories must apply for a Certificate of Authorization. For further information, please read the CofA information sheet.

A sole proprietorship (i.e. not an incorporated entity) is not required to hold a Certificate of Authorization. However, if the sole proprietor does not have professional liability insurance coverage in the same amounts and on the same terms and conditions as are required for a Certificate of Authorization, he or she must notify their clients of the absence of such insurance and must, before proceeding, obtain written authorization from each client to provide the professional services being contracted.

Application

One of the main requirements for a company to be granted a Certificate of Authorization is for them to maintain an adequate level of Professional Liability Insurance (PLI). You also need to designate a representative from your company to take responsibility for maintaining the required information with the APEGM office. This information includes the list of P.Eng. and P.Geo. who will use the company seal, and the updated insurance information each time it is renewed.

You will receive a Certificate stating the name of your company, and date the certificate expires. You will also receive a corporate seal that can be used by the Responsible Members to seal and initial their drawings.

Maintenance and Renewals

The regular CofA year runs (May 1 - April 30). We send out a renewal invoice around the end of February containing any special instructions or forms. Please have your renewal payment in by March 31, to ensure it is processed by the renewal date.

The Chief Operating Officer, or person designated to keep the CofA information up-to-date, must send in a copy of the current certificate of insurance each time they renew their Professional Liability Insurance. They are also required to notify us of any change to the list of Responsible Members who are registered with APEGM, and use the company seal.

Change of Company Name

If a company holding a certificate of authorization goes through a name change, they are required to send APEGM official notification, including: legal certificate of name change, and the updated Professional Liability Insurance policy in the new name.

Responsible Staff

The Registration Coordinator is responsible for accepting applications and maintaining documentation regarding Certificates of Authorization. This includes statements of professional liability insurance deductible amounts, and changes to a company's list of Responsible Members.
